Divorce FAQ: What kind of alimony will I receive or be required to pay?
The debate over alimony is a central point in many divorce proceedings, and asking how much alimony you’ll be required to pay, or will be receiving, is one of the most frequently asked divorce questions.
Of course, there’s not a clean cut or foolproof solution to follow. Instead, there are over a dozen factors which may be considered by the court. It’s also important to keep in mind that the alimony determination is entirely at the discretion of the court.
The chief concern of the court is the ability of the party seeking alimony to be wholly or partly self-supporting. The standard of living shared by the parties, the financial needs and resources of each party, the duration of the marriage, and the time necessary for the alimony-seeking party to gain education or training to find suitable employment are all factors. The contribution of each party to the well-being of the family, the circumstances which led to the estrangement between them, their age, and their physical and mental condition, are all considered.
